1. if the sole owner or act the co-sharer owners of the property object to the management of such property by the committee on the ground that he or they has or have made other arrangements for the management and utilisation of the property and if the committee is satisfies that the
arrangement. So made proper and adequate, or

2. if an objection is filed and allowed under this section.

-इस कानून में यह भी कहा गया है कि the property shall be vested only on the applications of the evacuees and if shall be vested with the right to dispose of property as he likes.

सन् 1957 में पाकिस्तान सरकार ने इस कानून में कुछ और संशोधन जारी Tee : Pakistan (Administration of Evacuees Property) Act XII of 1957. इस कानून में कहा गया-Properties of the person who is resident in any place in the territories now comprising India or in any area Occupied by India and is unable to occupy Supervise or manage in person his property in then Pakistan or is being Occupied, Supervised or managed by a person.' इस कानून से भी हिन्दुओं को उतनी सुविधा नहीं मिली, जितनी सुविधा East Pakistan Disturbed Persons and Rehabilition Ordinance 1964 में थी।

सन् 1965 के पाक-भारत युद्ध के कारण पाकिस्तान सरकार ने आपात स्थिति की घोषणा की। पाकिस्तान सरकार ने 1962 के अनुच्छेद सं. 1 और 2 के मुताबिक दिये गये जनता के मौलिक अधिकार को निरस्त कर दिया। 6 सितम्बर, 1965 में Defence of Pakistan Ordinance number XXIII के अनुसार Defence of Pakistan Rules 1965 जारी किया। Defence of Pakistan rules 1965 की 182वीं धारा में कहा गया है-'With a View to preventing the Payment of money to an enemy firm, and to provide for the administration and disposal by way of transfer or otherwise of enemy property and maters connected ther with or incidential there to, the Central Goverment may appoint a Custodian of enemy property for Pakistan and one or more Deputy Custodian and Asstt. Custodians of enemy property for such local areas as may be prescribed and may, by order-vest of provide for and regulate the vesting in the prescribed custodian such enemy property as may be prescribed.' इसके आधार पर पाकिस्तान प्रतिरक्षा कानून एक विधि के तहत सारी सम्पत्ति कानूनी तौर पर सरकार की हुई। इस सम्पत्ति के असली मालिकों की युद्धकालीन स्थिति में गिरफ्तारी या उनके इधर-उधर जाने पर प्रतिबंध के चलते उन सम्पत्तियों की रखवाली और सुव्यवस्था के नाम पर 'शत्रु-सम्पत्ति' के मालिकों के हित व अधिकार को पूर्ण रूप से सुनिश्चित करने के लिए तथा बाद में उन सम्पत्तियों के असली हकदार को वापस कर दिये जाने के वादे के साथ अस्थायी व्यवस्था के बतौर पाकिस्तान की केन्द्रीय सरकार ने Enemy property (Custody and Registration) Order 1965 जारी किया। बाद में Enemy Property (Land and Building) Administration & Disposal Order, 1966 के अन्तर्गत इन सम्पत्तियों के मूल्य और क्षतिपूर्ति के लेन-देन के लिए अलग-अलग ढंग से संरक्षण रहित देख-रेख और उसकी व्यवस्था का दायित्व पाकिस्तान सरकार के एक नुमाइंदा को सौंपा।
